Estate Planning
Estate planning allows you to protect your loved ones from dealing with the expensive and time-consuming Court system, or probate, while allowing you to manage your property during your lifetime.
The estate planning process begins with an initial consultation about planning, how it works and the decisions that you need to make.
A complete plan includes:
- A living trust,
- Pour-over Will(s),
- Powers of attorney,
- Advance health care directives, and
- Property transfer documents.
Our goal is to make the process as easy and pain free as possible.
Probate
Probate is known as the Court process in which property is transferred after a person’s death. This includes the collection, management and distribution of an estate. We work with you to guide you through the Court system and make the transition as smooth and as quick as possible.
Business Law
New and existing companies must comply with both Federal and State law for employees, industry requirements, among many other issues. If you miss one regulation or don’t do something correctly, it can be a costly event. Business planning helps avoid those problems.
Also, are there advantages that you might be missing? Are you thinking about forming a corporation, a limited liability company (LLC) or a partnership? We handle all types and can help you decide what is in your best interest. We are here to help work through the process and get you on track for success.
Fees
At Douglas Wright Law APC, we want you to understand the costs before you begin so you know what to expect. We pride ourselves on our honesty, integrity, and open communication.
Estate Planning
A complete estate plan for an individual: $2,000.00 flat fee (plus any recording fees for deeds – set by County)
A complete estate plan for a couple: $2,500 flat fee (plus any recording fees for deeds – set by County)
Probate
The attorneys’ fees are based on the estate appraisal and set by Probate Code §10810 as follows:
- 4% of the first $100,000 of the estate
- 3% of the next $100,000
- 2% of the next $800,000
- 1% of the next $9,000,000
- One-half % of the next $15,000,000
For example, for a $300,000.00 estate, the attorneys’ fees would be $9,000.00 (4% of first $100,000, 3% of second $100,000, and 2% of the next $100,000). These fees are paid by the estate at the end of the case.
** Small Estate Probate cases are usually a flat fee – depending on the case – and would be discussed during your consultation.
